A notice in the July 19, 2013 Federal Register, has a VERY important clause for all Doctors of Chiropractic! The Centers for Medicare and Medicaid Services (CMS) has asked for comment on whether or not Doctors of Chiropractic should be paid for Evaluation and Management (E/M) services. Keep in mind that this is only a request for comments at this point, but the fact that CMS is asking for information is very promising. They state the following purpose:
"We are seeking comment to assess whether there are situations in which E/M services that are not included in the CMT codes, but would meet the statutory requirements for chiropractor services, would be appropriate. We are not proposing to pay chiropractors for E/M services in CY 2014. If after receiving and analyzing public comment we determine that it would be appropriate to modify our policy with respect to chiropractors and E/M services, we would do so in future rulemaking."

In order for this change to take place, Doctors of Chiropractic must respond to the CMS inquiry and do so in a clear and consistent manner. ChiroCode, along with other professionals and professional organizations are currently teaming up to help provide providers with the tools they need in order to orchestrate a significant and compelling response.
Watch for announcements and further webinars from ChiroCode and other professional organizations. It is very important that we all work together in a concerted effort to provide CMS a solid case for issuing a final rule in favor of Doctors of Chiropractic and E/M services.
