There is a misconception that a non-emergency room physician or non-hospital emergency physician cannot submit a claim for services rendered in the emergency department.  The CPT codes for services rendered in the emergency department are 99281 through 99285.  When you look at the CPT manual, under Evaluation and Management, Emergency Department Services (99281-99825), you will see that it says the following:  The following codes are used to report evaluation and management services provided in the emergency department.
